Terms and Conditions for Waste Clearance Wembley

These Terms and Conditions set out the basis on which Waste Clearance Wembley provides waste clearance, rubbish removal, and related waste collection services. By booking a service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Client means the individual, business, organisation or other entity requesting the services of Waste Clearance Wembley.

Company, we, us or our means Waste Clearance Wembley, the provider of waste clearance and related services.

Services means any waste clearance, rubbish removal, bulky waste collection, garden waste removal, commercial waste collection, or related services provided by the Company.

Site means the property, premises, or location at which the Services are to be carried out.

Agreement means the contract formed between the Client and the Company comprising these Terms and Conditions and the details of the booking as confirmed by the Company.

2. Scope of Services

The Company provides waste clearance and rubbish removal services for domestic, commercial, and other Clients. This may include collection of household waste, office waste, garden waste, bulky items, and certain types of construction and renovation waste, subject to applicable regulations and these Terms and Conditions.

The exact scope of the Services, including the type and estimated volume of waste to be collected, the Site address, and the proposed date and time of collection, will be agreed at the time of booking. The Company reserves the right to adjust the scope of Services and related charges if the waste presented at the Site is materially different in type, volume, or accessibility from that described at the time of booking.

3. Booking Process

Clients may request a booking for waste clearance services by contacting the Company via telephone, email, or any booking form or system provided by the Company from time to time.

To make a booking, the Client will be required to provide accurate details, including but not limited to:

(a) full name and contact details; (b) the Site address; (c) a description of the waste to be collected; (d) any access restrictions; and (e) preferred date and time for the Service.

The Company may provide an estimate based on the information supplied by the Client. Any estimate is given in good faith and is not a binding quote until confirmed by the Company. The booking shall only be deemed accepted when the Company issues a confirmation via email, text message, or other written or electronic means.

The Client is responsible for ensuring all information provided is complete and accurate. The Company shall not be liable for any delay, additional cost, or failure to perform the Services arising from inaccurate or incomplete information.

4. Pricing, Estimates and Additional Charges

Prices for our Services are typically based on factors such as the volume and weight of waste, the type of waste, the labour required, and the accessibility of the Site. The Company may provide an estimated price in advance, which is subject to confirmation upon arrival at the Site.

If, upon arrival, it becomes apparent that the volume or type of waste, or the time and labour required, is greater than originally described, the Company will inform the Client and may adjust the price accordingly. The Client will have the option to accept the revised price or decline additional work beyond the originally estimated scope.

Additional charges may apply for:

(a) hazardous or difficult waste; (b) special handling or extra labour; (c) charges levied by disposal facilities; (d) waiting time caused by delays outside the Company’s control; and (e) parking fees, congestion charges, or similar costs incurred in providing the Services.

5. Payments and Invoicing

Unless otherwise agreed in writing, payment is due on completion of the Services. The Company may require full or partial payment in advance for certain bookings or for commercial Clients.

Payment can be made by cash, card, bank transfer, or any other method agreed by the Company. For commercial Clients with approved accounts, payment terms will be as set out on the invoice or otherwise agreed in writing.

If payment is not received on the due date, the Company reserves the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing late payment. The Company may also suspend or withhold further Services until all outstanding sums have been paid in full.

6. Cancellations and Amendments

The Client may cancel or amend a booking by contacting the Company as soon as reasonably possible. Any cancellation or amendment is only effective once acknowledged and confirmed by the Company.

If the Client cancels the booking more than 24 hours before the scheduled Service time, no cancellation fee will ordinarily be charged. If the Client cancels within 24 hours of the scheduled Service time, the Company reserves the right to charge a reasonable cancellation fee to cover administrative and staffing costs.

If the Company arrives at the Site at the agreed time and is unable to carry out the Services due to circumstances within the Client's control, including but not limited to lack of access, parking unavailability, or absence of an authorised representative, the Company may treat this as a late cancellation and reserve the right to charge a call-out or cancellation fee.

The Company will make reasonable efforts to accommodate changes in booking time or date requested by the Client, subject to availability. However, the Company does not guarantee that any request to change the booking can be fulfilled.

7. Client Obligations

The Client is responsible for ensuring safe, reasonable, and lawful access to the Site for the Company’s staff and vehicles. This includes arranging any necessary parking permits and ensuring driveways, access roads, and passageways are clear and safe.

The Client must ensure that all waste to be collected is clearly identified and separated if necessary. The Client must not include in the waste any items that are prohibited by law or by these Terms and Conditions, including hazardous, explosive, or otherwise dangerous materials, unless expressly agreed in writing and properly declared in advance.

The Client warrants that they have full authority to arrange for the removal of the waste from the Site and that removal of the waste will not contravene any law, regulation, lease, or agreement.

8. Waste Types and Regulations

The Company operates in accordance with applicable UK waste management legislation and guidance. All waste collected will be transported and disposed of only at authorised waste transfer or disposal facilities, and the Company shall use all reasonable endeavours to promote recycling and lawful reuse or recovery where possible.

Certain categories of waste are subject to special controls, including but not limited to asbestos, chemicals, oils, paint, clinical waste, electrical items, and gas cylinders. The Company reserves the right to refuse to collect any waste considered hazardous, prohibited, unsafe, or non-compliant with applicable regulations or our licensing conditions.

Where the Company agrees to collect controlled or regulated waste, the Client must provide full and accurate information as to the nature and composition of the waste and cooperate with any documentation or procedures required under waste regulations. Any failure to declare such waste may result in additional charges, refusal to collect, or termination of the Services.

9. Performance of the Services

The Company will use reasonable care and skill in performing the Services and will endeavour to complete the work within the agreed time frame. However, all times and dates for the performance of the Services are estimates only and may be subject to change due to traffic, weather, access conditions, or other factors beyond the Company’s reasonable control.

The Company does not guarantee that all waste presented will be removed unless it falls within the agreed scope of the booking and complies with these Terms and Conditions and applicable laws. The Company may remove additional items at its discretion, subject to extra charges as agreed with the Client.

At the end of the clearance, the Company will take reasonable steps to leave the cleared area tidy, within what is practical given the type of waste removed and the condition of the Site.

10. Limitation of Liability

Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Subject to the preceding paragraph, the Company shall not be liable for:

(a) any indirect, consequential, or special loss or damage; (b) loss of profits, business, or reputation; or (c) losses arising from delay or failure to perform caused by events beyond the Company’s reasonable control, including but not limited to traffic conditions, weather, industrial action, or third-party actions.

The Company’s total liability to the Client in respect of any claim arising under or in connection with the Agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total charges paid or payable by the Client for the Services giving rise to the claim.

The Client is responsible for removing or securing any fragile, valuable, or easily damaged items at the Site prior to the commencement of the Services. The Company will not be liable for damage to items or property that arise from necessary movement of waste in the normal course of the Services, provided the Company has exercised reasonable care and skill.

11. Insurance

The Company maintains appropriate insurance policies in respect of its operations, including public liability insurance, as required by applicable UK law and industry practice. Details of insurance coverage can be made available to the Client upon reasonable request.

12. Complaints

If the Client is dissatisfied with the Services provided, they should notify the Company as soon as reasonably practicable, providing full details of the issue and any supporting information. The Company will investigate and use reasonable efforts to resolve the complaint, which may include arranging a revisit, partial refund, or other appropriate remedy, at the Company’s discretion and subject to the facts of the case.

13. Data Protection and Confidentiality

The Company will handle any personal data provided by the Client in accordance with applicable UK data protection laws. Personal data will be used for the purposes of administering bookings, providing the Services, processing payments, and related administrative functions.

The Company will take reasonable steps to keep the Client’s information secure and will not disclose it to third parties except where necessary for the performance of the Services, for legal or regulatory reasons, or where the Client has given consent.

14. Termination

Either party may terminate the Agreement with immediate effect if the other party commits a material breach of these Terms and Conditions and, where the breach is capable of remedy, fails to remedy it within a reasonable period after being notified in writing.

The Company may also terminate the Agreement or suspend performance of the Services if it reasonably believes that continuing the Services would involve a risk to health, safety, or the environment, or would result in a breach of law or regulation.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

The Client may not assign, transfer, or subcontract any of their rights or obligations under the Agreement without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where reasonably necessary for the proper performance of the Services.

These Terms and Conditions, together with the details of the booking confirmed by the Company, constitute the entire agreement between the Client and the Company relating to the provision of the Services and supersede any prior understandings or agreements, whether written or oral.
